1. Acceptance of Terms

By accessing or using the artyFish platform (the "Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Service. ArtyFish LLC reserves the right to modify these terms at any time without prior notice. Continued use of the Service following any changes constitutes acceptance.

2. Use of the Service

You agree to use artyFish only for lawful purposes. You must not:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Impersonate any person or entity, or misrepresent your affiliation
  • Upload malware, spam, or any disruptive code
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for commercial solicitation without express written consent from ArtyFish LLC
  • Violate any local, state, national, or international law

3. User Content

You retain ownership of content you post. By submitting content, you grant ArtyFish LLC a worldwide, royalty-free, perpetual, irrevocable license to use, display, reproduce, and distribute that content in connection with the Service. You are solely responsible for all content you post. ArtyFish LLC does not endorse any user content.

4. Content Removal & Moderation

ArtyFish LLC reserves the sole and absolute right to remove, edit, or disable any content or account at any time, for any reason, without notice or liability. Physical marks may also be removed by anyone in a public space — artyFish is not responsible for the physical status of marks.

5. Intellectual Property

The artyFish name, logo, design, and all associated intellectual property are the exclusive property of ArtyFish LLC. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ARTYFISH LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTYFISH LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

You agree to indemnify, defend, and hold harmless ArtyFish LLC and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which ArtyFish LLC is incorporated, without regard to conflict of law provisions.
